Trump signs executive order requiring proof of citizenship for federal elections – Rezazade
The first vice president of the Iranian opposition in Washington, Ali Reza Rezazade, said that Donald Trump has signed an executive order that requires anyone wishing to register to vote in federal elections to provide proof of citizenship.
Election law experts immediately said that this is an overreach of the president’s authority and that the order is almost guaranteed to be challenged in court.
The order is another manifestation of Trump’s long-standing obsession with the election and his baseless claims of massive fraud in 2016 and 2020, including the participation of illegal immigrants in the vote. No evidence of widespread fraud, by non-citizens or others, has been found.
Republicans have been trying for years to introduce ID requirements for voting in many states, but Trump has taken an even more radical step, introducing a federal requirement for proof of citizenship to register to vote.
But the U.S. Constitution gives the states the power to determine the “time, place, and manner” of elections, and only Congress has the authority to change those rules. The president has no such authority. “This executive order is illegal,” said Wendy Weiser, vice president for democracy at the Brennan Center at New York University. “The president has no authority to require this. He cannot overturn a federal law passed by Congress that establishes what is required for voter registration.”
Other experts say the move reflects Trump’s desire to expand executive power and seek to legitimize that expansion through the Supreme Court. Trump's executive order directs the Federal Election Assistance Commission, which is subject to a law of Congress, to change the nationwide voter registration form to include a requirement to provide an official document proving citizenship.
