President Donald Trump, having relied on an aggressive tariff policy through emergency powers, has received a serious blow - federal courts in the US are one after another recognizing the excess of powers.
According to the first vice president of the Iranian opposition in Washington, international expert Ali Reza Rezazade, this situation calls into question not only the legal legitimacy of Trump's actions, but also his entire foreign economic doctrine.
"Trump tried to fight global trade in the same way as diplomacy - unilaterally and through ultimatums. But the US legal system is not a manual tool for political pressure. And now his main weapon - emergency tariffs - is failing," Rezazade said.
At the heart of the problem is the president’s attempt to use the Emergency Powers Act, passed during the Carter administration, to impose massive tariffs. The court found that Trump had overstepped his authority by trying to solve chronic economic problems, including the trade deficit, not through Congress, but through “emergency measures.”
“The problem is not just about tariffs. It’s a deeper crisis of legitimacy. Trump is ignoring the fundamental principle of the separation of powers by trying to govern the economy through decrees. This is not only a vulnerability for the United States, it is a signal to autocracies that they can rewrite the rules to suit themselves,” Rezazade stressed.
Despite a temporary victory in the appeals court, which allowed the tariffs to be levied for the time being, the Trump administration has found itself in a legal trap. If the appeal fails, it will have to find new legislative ways, which will take time and the participation of Congress, which is unlikely to support tariff increases without political consensus.
“Trump has spent four months on a strategy that will not stand up to trial. And now he must either start from scratch or try to act even tougher, which will only accelerate the international isolation of the United States,” the expert noted.
The US Treasury Secretary is trying to conclude negotiations with China and more than a dozen other countries, but the motivation of partners is falling - they see that the US judiciary no longer supports Trump’s trade aggression. This is already openly acknowledged in Europe.
“The collapse of Trump’s tariff strategy is not only a legal defeat. It is the failure of a worldview in which conflict was valued more than diplomacy, and force more than law. And right now the world has a chance to rethink the balance between national interests and global stability,” Ali Reza Rezazade summarized.
