Trump Asks Supreme Court to Allow Him to Fire Independent Agency Heads – Rezazade
Ali Reza Rezazade, the vice president of the Iranian opposition in Washington, says the Trump administration has asked the U.S. Supreme Court to support efforts to expand the president’s power. This is the first time Trump has formally asked the justices for support in his efforts to reform the federal bureaucracy.
The president is seeking the right to fire heads of independent agencies, including the Office of Special Counsel, which investigates civil service complaints. The head of that agency, Hampton Dellinger, recently filed a lawsuit after being fired in a terse email. Dellinger said the decision is illegal because it violates a law that protects independent agency heads from being fired without good cause, such as negligence, abuse or inefficiency.
Trump has already fired more than a dozen inspectors general, replaced the heads of ethics agencies, and removed the heads of agencies that protect government employees and investigate government misconduct.
The case will be the first major test for the Supreme Court, which has three Trump appointees. His initiatives on immigration, transgender rights, and government spending have faced resistance in lower courts and are now expected to reach the Supreme Court.
The U.S. Constitution gives the president the power to fire executive branch officials without giving them a reason, but Congress has passed laws protecting individual officials from being fired without good cause to preserve their independence. But in recent years, the Supreme Court has issued decisions that have expanded presidential power. The most significant was last summer’s decision that granted Trump and future presidents immunity from criminal prosecution for official actions.
The Dellinger trial will also test the extent to which Congress and the courts can restrain the executive branch. A federal court in Washington had earlier granted a temporary injunction allowing Dellinger to remain in office while the case was heard. His term was due to expire in 2029, having been appointed by Joe Biden.
But on Saturday, an appeals court denied the Trump administration’s request to overturn that decision, and the next day it filed a petition with the Supreme Court asking it to intervene.
